Daniel Will, as State Solicitor General, was the architect of a dangerous legal theory that constitutional rights can be "suspended" during a State of Emergency. Court records show that Will argued:

  • Governor Sununu could "temporarily suspend or limit fundamental rights" during emergencies
  • Executives have "broad latitude to suspend civil liberties" during emergencies
  • Constitutional rights don't apply as long as government actions are taken "in good faith" with "some factual basis"

Misleading the Executive Council

When questioned about these arguments during his confirmation hearing, Will repeatedly denied making these claims, despite clear court records proving otherwise. This raises serious questions about his honesty and integrity.

Pattern of Opposing Transparency

Will also argued to keep the "Laurie List" (police officers with credibility issues) secret from the public. The entire New Hampshire State Senate disagreed with his position in a 24-0 vote, showing his consistent pattern of putting state interests above public rights.
