HB 1642 would establish Extreme Risk Protection Orders (ERPOs), commonly known as "red flag" laws. These allow for the temporary seizure of firearms from individuals based on petitions alleging risk, often with limited due process and ex parte hearings.
While intended to prevent harm, ERPOs are prone to abuse, lack strong safeguards, and can endanger law enforcement during enforcement. They risk infringing on constitutional rights without adequate evidence or recourse.
Why NHFC Opposes HB 1642:
Provides insufficient due process—firearms can be taken without the owner present or able to respond immediately.
Opens the door to misuse for personal vendettas, custody disputes, or political targeting.
Puts officers at unnecessary risk during warrant service.
New Hampshire already has mechanisms (mental health commitments, domestic violence orders) to address genuine threats without broad new restrictions.
